I am not sure why you make this deduction, it is not correct. The square you mention (with pencilmark 28 in box 3) is a "2", while the "8" of this box must be placed two squares above it. When looking at row 3, you will notice that there is no other place for the "2" than the one with the pencilmarks mentioned. BTW, the square right from it (with the pencilmarks 17) can't be 2 because there is a "Naked Pair" situation (with 2, 5) that I visualized by the blue circles -> "2" must definitely be in one of these both squares in that column.
